1. About these terms
These terms apply to your use of auzgallerytec.site and to any dealings with AUZ Gallery Pty Ltd (ABN 90 703 631 396, ACN 703 631 396) of Epping VIC 3076 ("AUZ Gallery", "we", "us"). By using the website or engaging our services you agree to them. Nothing in these terms limits any right you have under the Australian Consumer Law.
2. Using this website
This website gives general information about our exhibitions, art sales, framing, hanging and events. We try to keep it accurate and current, but descriptions of services are a guide only. The details of any particular job are set out in our written confirmation to you.
You must not use the website in a way that is unlawful, interferes with its operation, or infringes anyone else's rights.
3. Quotes, sales and bookings
- Every quote, sale, framing order, installation or event booking is confirmed by email, setting out the price, what is included and the expected timing.
- A contract is formed when you accept that confirmation in writing and pay any deposit stated in it.
- Prices are in Australian dollars. Any GST, delivery or installation costs will be stated in the confirmation.
- Original artworks are unique. Colours and textures may look different on screen from the physical work, so we encourage you to view a work, or ask for further photos, before buying.
- Any cancellation or change terms specific to a job, such as for custom framing cut to size, will be set out in the confirmation.
4. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)). For major failures with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to compensation for any other reasonably foreseeable loss or damage from a failure in the goods or service.
A change of mind is not a failure under the Australian Consumer Law. Whether we accept change-of-mind returns for a particular work will be stated in the sale confirmation.
5. Artworks in our care
Where you leave an artwork with us for framing or display, we will take reasonable care of it while it is in our possession. Please tell us about any existing damage, fragility or special handling needs when you hand it over. We will agree a collection or delivery date with you in writing.
6. Intellectual property
The text, design and layout of this website belong to AUZ Gallery Pty Ltd. You may view and print pages for personal use, but not copy or republish them commercially without our written permission.
Copyright in each artwork stays with the artist, in line with the Copyright Act 1968 (Cth). Buying an original work gives you ownership of the physical object, not the right to reproduce it, unless the artist agrees otherwise in writing.
7. Limitation of liability
To the extent permitted by law, and subject always to the consumer guarantees in section 4, we are not liable for any indirect or consequential loss arising from your use of this website or our services.
Where the law allows us to limit our liability for a failure to comply with a consumer guarantee for goods or services not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited, at our option, to supplying the goods or services again, repairing or replacing the goods, or paying the cost of doing so.
8. Termination
We may suspend or end access to this website, or decline or end an engagement, if these terms are breached or the law requires it. If we end an engagement other than for your breach, we will refund any amount paid for goods or services not yet provided. Either party may end an engagement as set out in its written confirmation. Clauses that by their nature should continue, including sections 4, 6 and 7, survive termination.
9. Governing law
These terms are governed by the laws of Victoria (VIC), Australia. Each party submits to the non-exclusive jurisdiction of the courts of Victoria and the courts entitled to hear appeals from them.
